Event & Venue
Private community event at TORTUE Hamburg, 12.12.2025, 19:00 – 23:00.
Admission is limited and by invitation/link only.
1) Tickets, Price, Taxes
- Ticket price: EUR 150.00 (gross, incl. 19% VAT) per person.
- The ticket covers admission including food & beverages; there is no entitlement to particular dishes, brands, or quantities.
- Tickets are personal and intended for private use. Name transfers may be permitted upon request until [2 days before event].
2) Selection & Admission
- Registration does not guarantee final participation.; attendance may be curated/limited at the Organizer’s discretion.
- If you are not selected, your payment will be refunded in full.
- Venue house rules (TORTUE Hamburg) apply. The Organizer may refuse admission or remove guests for good cause (e.g., security concerns, harassment, intoxication) without compensation.
3) Cancellations, No-Show, Refunds
- Note for consumers: the statutory right of withdrawal does not apply to services related to leisure activities with a specific date (Sec. 312g(2) No. 9 BGB).
- Contractual policy:
- Up to 7 calendar days before the event start: cancellations are accepted; the payment processor’s fees are non-refundable, and an administration fee of EUR 50 will be deducted.
- Less than 7 days before the event or no-show: no refund.
- Rationale: within 7 days we typically cannot re-allocate places on short notice.
- If the event is postponed or materially changed, tickets remain valid for the new date; if you cannot attend, you may request a refund. If the event is canceled by the Organizer, you will receive a full refund of the ticket price.
4) Liability
- Participation is at your own risk.
- The Organizer is liable without limitation for intent and gross negligence and for injury to life, body, or health. For slight negligence, liability applies only for breach of a material contractual duty (Kardinalpflicht) and is limited to typical, foreseeable damage.
- Mandatory statutory liability remains unaffected.
5) Valuables & Watches
- The Organizer provides no insurance cover for watches, valuables, or personal items brought by guests.
- Swisswatches will provide security personnel but cannot offer insurance for lost or stolen personal belongings.
- The Organizer accepts no liability for loss, theft, or damage to such items unless caused by intent or gross negligence of the Organizer. Please arrange your own insurance where appropriate and keep valuables under supervision.
6) Photography & Videography
- The Organizer (and commissioned service providers) may take photos and video at the event for documentation and promotion (e.g., website, magazine, social media, press).
- GDPR legal basis: legitimate interests (Art. 6(1)(f) GDPR) to document and communicate the event; for close-ups/portraits where you are the main subject, the Organizer may request consent (Art. 6(1)(a) GDPR).
- Group and ambience shots may depict you in the background.
- Opt-out on site: if you do not wish to be recognizable, please inform our team at check-in; we will provide a visible marker and brief the photographer accordingly. You can also contact us afterward to request review/removal where feasible.
7) Data Protection (GDPR)
- Controller: Swisswatches.media GmbH (see Organizer).
- Purpose: ticketing & admission management, event execution (incl. catering logistics, security, seating), pre-/post-event communication; visual documentation as above.
- Legal bases: contract performance (Art. 6(1)(b) GDPR), legal obligations (e.g., tax; Art. 6(1)(c)), legitimate interests (Art. 6(1)(f)).
- Recipients: ticketing/payment providers (e.g., Eventbrite/PSPs), venue (name list/logistics), photographers, IT/hosting.
- Storage: retained as required by law and as long as necessary for the stated purposes.
- Rights: access, rectification, erasure, restriction, objection (incl. to photo processing), data portability, and complaint to a supervisory authority.

8) Changes, Program, Force Majeure
- The Organizer may make reasonable changes to schedule, program, speakers/guests, or menu.
- In cases of force majeure or events beyond the Organizer’s control (e.g., official orders, safety issues), the event may be adapted, postponed, or canceled.
9) Governing Law & Venue
- These Terms are governed by German law.
- If you are a merchant within the meaning of the German Commercial Code, exclusive venue is the courts at the Organizer’s registered office (Bremen). Otherwise, statutory venues apply.
10) Severability
If any provision is invalid, the remainder stays in force; the invalid provision will be replaced by a valid one closest to the original purpose.
